By using the website, portal, or services of India Stat Filing (“India Stat Filing”, “we”, “our”, “us”), you (“Client”, “you”) agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use our services.
- Introduction
- India Stat Filing provides assistance, preparation, filing, and advisory support for statutory compliance, accounting, bookkeeping, tax filings, and related regulatory submissions in India.
- Services do not include legal, audit, or certification opinions. Approval or acceptance by statutory authorities remains the client’s responsibility.
- Scope of Services
We assist with:
- Accounting & Bookkeeping: Maintaining books, ledgers, financial statements, reconciliations, payroll summaries.
- Tax & Compliance: GST, Income-tax, TDS/TCS, MCA filings, EPFO/ESIC, Shops & Establishment, FSSAI, IEC, RBI/FEMA submissions.
- Registrations & Licensing: Company/LLP registration, PAN/GST/Import Export Code, and other statutory registrations.
- Other Statutory Services: Filing annual returns, compliance certificates, notices, and other filings as required under Indian law.
- Client Obligations
- Provide authentic, accurate, and complete documents, records, and information.
- Maintain updated contact details and credentials for any portals.
- Review drafts, reports, and returns; your approval constitutes final sign-off.
- Ensure authority to share third-party data if required.
- Professional Fees & Payments
- Fees are charged as per the agreed proposal/invoice.
- Payments must be completed to enable processing or submission.
- Taxes, government fees, stamp duties, penalties, notary, courier, and third-party charges are borne by the client.
- Refunds & Cancellations
- Fees for services initiated or processed are non-refundable.
- Refunds or service credits may be issued only if failure is solely due to India Stat Filing error.
- Government or third-party fees are never refundable.
- Use of Platform & Acceptable Conduct
- Keep your account credentials confidential; you are responsible for activities under your account.
- Do not engage in unauthorized access, scraping, automated actions, reverse engineering, or any activity that disrupts our platform.
- Third-Party Dependencies
- We may rely on government portals (GSTN, MCA, Income-tax e-filing, EPFO, ESIC, DGFT), APIs, cloud services, or payment gateways.
- India Stat Filing is not liable for downtime, delays, errors, or rejections caused by these third parties.
- Intellectual Property
- All content, templates, software, and materials are our intellectual property.
- Clients are granted a limited, non-transferable license to use deliverables for internal business and statutory purposes only.
- Confidentiality
- Both parties must protect confidential information with reasonable care.
- Disclosure is allowed only when required by law or with written consent.
- Privacy & Data Protection
- We process client data in compliance with Indian laws (IT Act 2000, DPDP Act 2023) and GDPR for EU/EEA users.
- Personal and business data is used only for service delivery, statutory compliance, security, and consented communications.
- Limitation of Liability
- Our liability is limited to professional fees paid for the engagement.
- We are not liable for indirect, incidental, consequential losses, portal downtime, government delays, or policy changes.
- Indemnity
- You agree to indemnify India Stat Filing against losses arising from:
- Breach of these Terms;
- Inaccurate or incomplete data provided;
- Misuse of our platform;
- Violation of law or third-party rights.
- Force Majeure
- India Stat Filing is not liable for delays or failures caused by events beyond reasonable control (natural disasters, strikes, government actions, pandemics, portal downtime).
- Termination
- Access may be suspended or terminated for violations, non-compliance, or security concerns.
- Clauses relating to confidentiality, IP, liability limits, and data protection survive termination.
